Crypto Enforcement Slows as CFTC Responds to DOJ’s New Prosecution Guidelines

CFTC Acting Chair Caroline D. Pham has directed the agency to scale back enforcement in the crypto space, aligning with the DOJ’s recent shift away from aggressive prosecution.

The CFTC will no longer pursue minor registration violations unless there’s clear evidence of intentional misconduct. Pham criticized past federal overreach, saying it hurt innovation and trust in regulation. Her directive focuses enforcement on serious offenses like fraud and manipulation, aiming to bring clarity and fairness to digital asset markets while conserving agency resources.

This move follows Executive Order 14219 and DOJ policy updates limiting legal actions in the crypto sector.
