Legal Victory: Grayscale Triumphs Over SEC in Lawsuit Seeking Bitcoin ETF Conversion

A D.C. court has sided with Grayscale, the prominent crypto asset manager, in its lawsuit against the U.S. Securities and Exchange Commission (SEC), challenging the denial of GBTC’s conversion into a bitcoin exchange-traded fund (ETF).
The ruling, issued by the United States Court of Appeals for the District of Columbia Circuit, marks a significant victory for Grayscale. With the court unanimously supporting their stance. The decision has broader implications for those advocating for increased bitcoin exposure through the security of an ETF. Grayscale’s CEO, Michael Sonnenshein, expressed his satisfaction with the verdict. Emphasizing that the court’s ruling favored Grayscale’s position in their fight against the SEC’s denial of GBTC’s ETF conversion. Grayscale had sought to transform its flagship bitcoin trust (GBTC) into a spot bitcoin ETF, a move thwarted by the SEC’s opposition.
The regulatory body’s inconsistency in treating similar products led to its denial being deemed “arbitrary and capricious” by Circuit Judge Neomi Rao, who joined two other judges in vacating the order, thus granting Grayscale’s petition for review.
