Kenya’s New Crypto Rules Risk Driving Startups Offshore, Industry Warns

Kenya’s proposed crypto regulations are raising concerns among industry groups, who warn that strict licensing and capital requirements could push local startups out of the market.

Under draft rules, some firms—especially stablecoin issuers—may need up to $3.86 million in paid-up capital, creating significant barriers for smaller players.

Industry representatives argue that the high compliance costs, combined with insurance and regulatory obligations, could concentrate the market among large, well-funded companies and drive activity to offshore or unregulated platforms. While regulators aim to protect investors and bring structure to the fast-growing sector, critics say the current framework risks stifling innovation and weakening Kenya’s position as a leading fintech hub in Africa.
