Dutch Law Would Tax Bitcoin and Ethereum Paper Gains at 36% Starting in 2028

Dutch lawmakers have approved a controversial new tax framework that would impose a 36% levy on unrealized capital gains for assets including Bitcoin and Ethereum. Treating annual price increases as taxable income even if investors do not sell.

The reform part of the “Actual Return in Box 3” system. Aims to overhaul the Netherlands’ savings and investment tax code by taxing actual investment returns such as crypto gains, interest and dividends. Rather than assumed hypothetical returns.

Critics have warned that taxing unrealized gains could force investors to sell assets purely to cover tax bills and may dampen long-term investment incentives, particularly for digital asset holders exposed to volatile price swings. The law, which still requires approval by the Dutch Senate, is slated to take effect on January 1, 2028. And has sparked debate over fairness. Liquidity challenges and the broader competitiveness of the Netherlands as a hub for crypto investing.
